60 business days is twelve working weeks. The sixtieth working day is also the ceiling section 10(4) of the Freedom of Information Act 2000 sets on any extended time for compliance made by regulations.
Where sixty working days comes from
Section 10(4) of the Freedom of Information Act 2000 lets regulations replace the ordinary twentieth working day with a later day, and caps that day at the sixtieth working day following the date of receipt. Regulation 3 of the 2004 Regulations uses that power, setting the compliance date at the sixtieth working day following the date of receipt for the categories it covers.
This is a rare thing worth noticing: a long period that is genuinely counted in working days rather than calendar ones. Most long statutory periods in English law are expressed in months or in calendar days precisely because counting sixty working days by hand is unpleasant. Where the drafter has gone to the trouble, the working-day count is deliberate.
Twelve working weeks in calendar terms
Twelve working weeks, or roughly three calendar months. Close enough to a quarter to be tempting, and far enough off to be worth checking against the real figure.
| Quantity | Amount |
|---|---|
| Days on the wall calendar | 89 days |
| Working weeks counted | 12 weeks |
| Weeks of calendar time | 12.7 weeks |
| Months of calendar time | 2.9 months |
| Saturdays and Sundays removed | 26 |
| Closures removed from the count | 3 |
| Day of the week it lands on | Monday |
Sixty working days is not a quarter
Measured against the England and Wales bank holiday list, a calendar quarter contains 61 to 65 business days depending which quarter it is and where the holidays fall. Sixty working days is close to that but not equal to it, and the two are anchored quite differently: a quarter has fixed start and end dates, while sixty working days runs from whatever day you began counting.
If a contract says one quarter, do not substitute this count. If it says sixty working days, do not report a quarter-end date.
