5 business days is one full working week. Five days is also the line in CPR 2.8(4): when a court period in England and Wales is 5 days or less, a Saturday, Sunday, bank holiday, Christmas Day or Good Friday inside it does not count.

The five-day line in the Civil Procedure Rules

Rule 2.8(4) is unusually blunt for a counting provision. Where the specified period is 5 days or less and includes a Saturday or Sunday, or a Bank Holiday, Christmas Day or Good Friday, "that day does not count". The rule carries its own worked example: notice of an application must be served at least 3 days before the hearing, an application is to be heard on Monday 20 October, and the last date for service is Tuesday 14 October, because the intervening weekend drops out.

Above five days the rule reverses. A period of 6, 7 or 14 days under the CPR counts every day, weekends included, and only the final day moves if it lands badly. So a short court period and a slightly longer one are not the same kind of measurement at all, and the difference is not proportional to the numbers.

Why the rule names Christmas Day and Good Friday separately

It reads like belt and braces. It is not. Schedule 1 to the Banking and Financial Dealings Act 1971 lists only five bank holidays for England and Wales: Easter Monday, the last Monday in May, the last Monday in August, 26th December if it is not a Sunday, and 27th December in a year in which 25th or 26th December is a Sunday.

Christmas Day and Good Friday are not on that list. They are common-law holidays, which is why any drafter counting court time has to name them on their own. New Year's Day and the early May holiday are not on the list either; they are appointed by royal proclamation under section 1(3) of the same Act. Of the eight bank holidays England and Wales actually keep, the statute itself names four.

One working week, measured against the calendar

Counted from this page's reference date against the England and Wales bank holiday list. Counted from a weekday with no bank holiday inside, a five-day window crosses exactly one weekend, so the only thing that can stretch it further is a bank holiday landing on a weekday inside it.

Bank holidays inside this five-day window

No England and Wales bank holiday falls between the reference date and the answer, so every day taken out of this count is a Saturday or a Sunday.

Where five working days turns up outside court

None of these is a legal requirement. They are trade practice, and the contract governs.

  • Standard order acknowledgement and non-urgent supplier support, where one working week is the unit everyone recognises.
  • Internal approval chains that want a full week of desk time without arguing about which Monday counts.
  • Escalation clauses that give the other side a week to respond before the next tier engages.
