There is no federal fifteen-business-day deadline
This is worth stating plainly, because the internet is full of pages that say otherwise. The Freedom of Information Act gives an agency "20 days (excepting Saturdays, Sundays, and legal public holidays)" to decide whether to comply with a request, under 5 U.S.C. 552(a)(6)(A)(i), and the same twenty for an appeal under (a)(6)(A)(ii). Unusual circumstances buy an extension of "not more than ten working days" under (a)(6)(B)(i). Nowhere in that scheme is there a fifteen.
An earlier version of this page attributed a fifteen-business-day FOIA window to HUD. That was wrong and has been removed. FOIA sets one government-wide period and HUD is not exempt from it.
The fifteens that do exist, and what they count
Several federal deadlines are fifteen days. None of them is fifteen business days.
- A federal employee has fifteen days after the notice ending EEO counselling to file a formal complaint, under 29 CFR 1614.106(b). Part 1614 states its own counting rule at 1614.604(a): "All time periods in this part that are stated in terms of days are calendar days unless otherwise stated."
- Those fifteen calendar days still get the weekend courtesy. Under 1614.604(g) the last day is included "unless it falls on a Saturday, Sunday or Federal holiday, in which case the period shall be extended to include the next business day." That is an end-of-period adjustment, not a business-day count.
- Fifteen business days is common in master services agreements, RFP response windows and software escrow release terms. Those are negotiated numbers. Read the definitions clause, because contracts differ on whether a holiday means a federal holiday or a day the parties are closed.
