28 business days is nearly six calendar weeks. Twenty-eight is one of the four numbers the Federal Rules of Civil Procedure use for short deadlines, and in every one of those rules it means twenty-eight calendar days.

Why twenty-eight keeps appearing in court rules

When the Federal Rules of Civil Procedure were restructured in 2009, short periods were reset to multiples of seven: seven, fourteen, twenty-one and twenty-eight days. The reason is stated in the committee note. A period measured in whole weeks ends on the same day of the week it began, which removes an entire class of counting mistake. Rule 59(b) gives twenty-eight days to move for a new trial and Rule 59(e) gives twenty-eight days to move to alter or amend a judgment, both measured from entry of judgment.

That design only works with calendar days, and Rule 6(a)(1)(B) supplies them: "count every day, including intermediate Saturdays, Sundays, and legal holidays". Convert one of those twenty-eights to business days and the weekday alignment disappears, which is why no federal rule does it.

So where does a twenty-eight-business-day window come from

In practice, from operations rather than from law. Common uses:

  • Manufacturing and logistics lead times, where four working weeks plus a buffer is quoted as twenty-eight business days to avoid holiday disputes.
  • Background screening and vetting programmes that need a fixed number of working days for third-party responses.
  • Change-freeze and stabilisation periods that need to cover six calendar weeks of operational risk.
  • Commonwealth-influenced contracts, where "28 days" is an ordinary drafting unit and someone has converted it to business days on the way into a schedule. This page previously claimed twenty-eight business days was a visa-processing acknowledgment window used by US immigration services. No such fixed federal business-day period was found, and the claim has been removed.

Twenty-eight business days on other calendars

Twenty-eight working days runs across five or six weekends, so a national holiday season has room to sit inside the window. A country lands later than the US date when it closes for more days in this stretch than the United States does, and earlier when it closes for fewer.
